of Kiryas Joel NOTICE TO BIDDERS NOTICE IS HEREBY GIVEN that Sealed Bids for Kiryas Joel Park and Ride Lot Construction Project will be received by the Village Administrator, Village of Kiryas Joel, Municipal Building, 51 Forest Road, Suite 340, Monroe, New York 10950 until 11:00 AM on December 2, 2009, and at that time and place bids will be publicly opened and read aloud. This project includes the construction of a 118 vehicle park and ride lot and the reconstruction of approximately 500 ft. of Bakertown Road in the Village of Kiryas Joel, New York. The new parking lot, roadways and bus loading areas will be constructed of Hot Mix Asphalt over a Modified Subbase Course. Concrete sidewalks, curbing and a closed drainage system with underground detention will be installed. Other amenities include landscaping, bus shelters, signing, striping and ornamental lighting for the park and ride lot and Bakertown Road. Disadvantaged Business Enterprise (DBE) goal is 9%. As of November 9, 2009 and thereafter, between the hours of 9:00 AM and 4:00 PM Monday through Thursday, Contract Documents may be examined at the office of the Village Consultant, and full sets may be obtained from the office of the Project Engineer, Paul Bohl, Stantec Consulting Services, 3 Columbia Circle, Suite 6, Albany, NY, 12203 (518) 452-4358 upon payment of $50 for each set and $10 Postage (non refundable) made payable to the Village of Kiryas Joel. The New York State Department of Transportation (NYSDOT) requires that all bidders and subcontractors present evidence of experience, ability and financial standing. Subcontracting is permitted as descried in Section 108-05 of the NYSDOT Standard Specifications of May 4, 2006. All bids must be accompanied by a non-collusion statement in order to be considered. The Village reserves the right to reject any and all bids for any cause whatsoever. Bids shall be awarded in accordance with General Municipal Law Section 103. The Contact will be awarded to the successful bidder subject to the approval of New York State Department of Transportation. Village of Kiryas Joel The resolution, a summary of which is published herewith, has been adopted on October 6, 2009 as a further amendment to the bond resolution adopted March 7, 2006, amended on March 4, 2008 and further amended on April 1, 2008, and an abstract thereof has been published and posted as required by law and the period of time has elapsed for the submission and filing of a petition for a permissive referendum and a valid petition has not been submitted and filed. The validity of the obligations authorized by such resolution may be hereafter contested only if such obligations were authorized for an object or purpose for which the Village of Kiryas Joel, in the County of Orange, New York, is not authorized to expend money or if the provisions of law which should have been complied with as of the date of publication of this notice were not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of publication of the notice, or such obligations were authorized in violation of the provisions of the constitution. Gedalye Szegedin Village Clerk BOND RESOLUTION OF THE VILLAGE OF KIRYAS JOEL, NEW YORK, ADOPTED MARCH 7, 2006, AMENDED ON MARCH 4, 2008 AND FURTHER AMENDED ON APRIL 1, 2008 AND OCTOBER 6, 2009, AUTHORIZING THE CONSTRUCTION OF A WOMEN'S SERVICES CENTER IN THE VILLAGE, STATING THE ESTIMATED MAXIMUM COST THEREOF IS $12,200,000, APPROPRIATING SAID AMOUNT THEREFOR, AUTHORIZING THE ISSUANCE OF NOT TO EXCEED $12,200,000 SERIAL BONDS OF SAID VILLAGE TO FINANCE SAID APPROPRIATION, AND AUTHORIZING ANY GRANT FUNDS TO BE RECEIVED FROM THE UNITED STATES OF AMERICA AND/OR THE STATE OF NEW YORK OR ANY OTHER SOURCE TO BE EXPENDED TO PAY ALL OR PART OF SAID APPROPRIATION The object or purpose for which the bonds are authorized is to construct a women's services center, in the Village, at the estimated maximum cost of $12,200,000. The period of probable usefulness is twenty-five (25) years. The amount of obligations to be issued is $12,200,000. It is expected that grant funds shall be received from the United States of America and/or the State of New York or other sources in an aggregate amount that may be sufficient to pay the cost of such project. Serial bonds shall be issued pursuant to this resolution only in the event that such grant funds are insufficient to pay the full cost of the project. Any grant funds to be received from the United States of America or the State of New York or any other source with respect to such project are authorized to be applied towards the cost of said object or purpose. A complete copy of the bond resolution summarized above shall be available for public inspection during normal business hours at the office of the Village Clerk, Municipal Building, 51 Forest Road, Monroe, New York.
