Proposal to create new village withdrawn to correct errors

A group proposing to incorporate a new village in southern Blooming Grove has temporarily withdrawn its petition in order to correct technical errors identified by landowners fighting the proposal, Blooming Grove Supervisor Charles Bohan said yesterday.
Bohan said he returned the petition Feb. 4, two days after the group that submitted it Dec. 13 requested it back. He said the documents had three problems, including duplication of several names on a list of inhabitants of the proposed village.
"They're going to clean all that up and resubmit it," he said.
More than 1,000 people had signed the petition to hold a referendum on incorporating a 4.8-square-mile Village of South Blooming Grove. Proponents say creating a village will help preserve the area's zoning and character.
But several large landowners opposed to the idea filed technical objections to the petition, which a state Supreme Court justice ordered Bohan to consider last month after opponents missed a deadline to file them.
Bohan said yesterday that he hadn't rendered a decision because the group took back the petition to correct the defects.
Terry Rice, a Suffern lawyer representing the opponents, said he knew of no legal authority to withdraw the petition.
"It's a very strange situation," he said.
