Opposes new village
I am writing in regard to your article on July 26, "Hasidim seek village status," wherein the Viznitz sect plans to establish its own religious-based municipality in Sullivan County. I am strongly opposed to this for two reasons.
First, I find it unconstitutional that any municipality should be "religious based." This firmly contradicts the separation between church and state. This would in essence bar any non-Hasidim from residing within the borders of the village, thus creating a discriminatory municipality.
Second, I am opposed to the Hasidim imposing their urban needs within our rural communities. Their leaders state that they would change zoning within the village because of the need for multifamily housing close to synagogues and stores. If this is what they desire, then they should concentrate on settling in existing urban communities that can accommodate their needs, rather than forcing their lifestyle on those who chose to move away from urban environments. In essence, they are forcing their square peg into our round hole.
I implore the Sullivan County Legislature to do everything they can to block these urban, discriminatory neighborhoods from our rural communities.

Don't need new village
To the residents of Sullivan County: You really don't need another Hasidic village being incorporated by the county or New York state itself. You already have in some sort of way a peaceful habitat without adding anymore people to the population. Taxes are already high as it is, and if their village is given permission to exist, it is your tax money that will help build their new village.
Look at Kiryas Joel. The average tax bill is roughly $6,000 a year for the Town of Monroe and Town of Blooming Grove. They will be using your water or your tax dollars to have water imported from the aqueduct to serve their village. State aid will go to them as state aid has gone to private or parochial schools for educating their children.
You guys have enough problems with the casinos coming in with all kinds of promises of revenue on taxes going to state aid – just like the state lottery was supposed to do, but it hasn't done the job for supplemental educational needs. It went into the politicians' pockets.

Monticello – Leaders of a Hasidic group might drop their plans to form a village in the Town of Thompson.
"We are in the middle of negotiations," Thompson Supervisor Tony Cellini said yesterday after a meeting with three leaders in his office.
On July 22, the Hasidic group filed papers to create the village of Ateres off Route 42 between Monticello and Fallsburg on Gibber Road.
With a key hearing coming up on Tuesday, Cellini has been wheeling and dealing to get the group to drop the idea. The town would lose control of zoning in the new village.
Cellini said yesterday's 90-minute meeting was "fruitful," and he's cautiously optimistic a deal will be worked out by Monday or Tuesday.
"Everything is going well," he said.
The Hasidic group is made up of members of the Viznitz sect, which is largely based in the village of Kaser in Rockland County. Right now, the Viznitz community in Thompson consists of about 50 year-round families and a yeshiva. The group wants to attract at least another 100 families.
Chayim Fried, the group's spokesman, wouldn't comment yesterday on negotiations.
The group's leaders have previously said they want zoning flexibility to develop about 350 acres in the town. They want to build multifamily units and make other modifications not permitted by Thompson's building codes.
Cellini will preside over Tuesday's hearing to review the technical points of the village petition. That hearing will be canceled if the group drops its petition.
Gov. George Pataki is watching the proceedings closely. Michael Fragin, an executive assistant to the governor, has met with Cellini and talked with the group's leaders. The governor plans to take no position on the proposed new village, Cellini said.
Fragin declined to comment on his involvement.
Other politicians appear to be rooting for a deal to avoid a new village.
Sen. John Bonacic, R-C-Mount Hope, generally opposes adding extra layers of government, an aide said.
"Forming a new village kind of goes against the trend," said Chris Cunningham, chairman of the Sullivan County Legislature. "I would hope they work it out with the town."

Hasidic leader tells about new village

Kiamesha Lake – A Hasidic village off Route 42 in the Town of Thompson is nothing to fear, a leader told the Town Board last night.
"We are not the kind of people who are hostile or aggressive," said Nuchem Lebovits, the primary organizer in the drive to incorporate the village between Fallsburg and Monticello on Gibber Road.
"We are more of an asset than anything else."
Lebovits, an insurance salesman and financial adviser from Monsey, stammered nervously at times while spelling out the plans. It was the first public presentation since the group filed the petition on July 22 to incorporate.
But Town Board members said they don't like it.
"Do you find it reasonable to form a village to circumvent our zoning?" Supervisor Tony Cellini said.
The community comes from the Viznitz sect, which is primarily based in the Town of Ramapo and Village of Kaser in Rockland County.
Lebovits said the group wants to attract another 100 families. They have roughly 50 now and need more people to support the yeshiva, he said.
He said the village would want to use all the town services. They'd be willing to rent a room in Town Hall for an office.
Cellini, who will preside over an incorporation petition hearing on Aug. 9, said the board would be willing to sit down and talk.

KIAMESHA LAKE — A religious community located off of Gibber Road in Kiamesha Lake has filed a petition seeking to incorporate itself as its own village within the Town of Thompson.
The community – whose roads include Feldman Circle, Gafen Lane, Silver Terrace and Yeshiva Road – would call themselves the Village of Ateres.
The Town of Thompson Board is not so willing to let that happen, however.
In an emergency meeting yesterday, Supervisor Anthony Cellini said he is concerned about the negative impact such a move would have on the town's taxes and infrastructure. Cellini and the board indicated they do not want to see a community like Orange County's controversial Kiryas Joel in their town.
The property totals 377.54 acres and includes a year-round yeshiva (religious school). According to the group's liaison, Chayim Fried, there are currently 53 families who live there year-round, along with between 200-300 yeshiva students.
The town may object to their ability to form a village, based on the possibility that not all of the residents are regular inhabitants. Michael Mednick, the Town of Thompson attorney, said that state law requires 500 ''regular inhabitants'' before a community can incorporate itself into a village.
Fried said his group wants to start its own village because ''building and developing in the town takes more time. It will be easier for us to build [as a village].''
Cellini and Town Councilman William Rieber said the issue is about zoning. The community wants to be able to build at a higher density than the town code allows. Fried said he is looking to bring several hundred more people up from Rockland County into this community.
Cellini said the matter will likely go to litigation. First, there will be a hearing – the town will select a date at its next board meeting on August 2. That date will likely be within two weeks after the meeting.
According to Mednick's interpretation of the law, Cellini would preside over the hearing and decide whether the community has filed its petition in the correct manner and is following state law. Town Councilman John Washington is expected to object to the group's procedure.
''This will not be an easy task on both sides,'' said Cellini.
According to figures provided by Cellini, the taxable value of the community is over $8 million. They are assessed at approximately $9.3 million but receive over $400,000 in tax exemptions for religious-related activities. They pay approximately $269,400 in county, school and town taxes combined. If the village separated itself from the town, they could have their own assessor.
Fried said he would still like to use the town's services. But by becoming a village, their tax rate would be less. Those services include fire protection, sewer hookup, road maintenance and plowing.
''Our concern is whether our infrastructure can handle what we have now,'' said Cellini.
Fried is confident that the law is on his community's side.
''If everything is according to the law, they have to let us [become a village],'' said Fried.

Residents petition for village in Town of Thompson

A group of residents in the Town of Thompson has petitioned the town to allow it to establish the Village of Ateres. The formal application was signed by three town residents, Chayim Fried, Abraham Taub and Chaim Neiman.

According to legal documents filed with the application, the population of the village would be 596 at this time and cover no more than five square miles, or 366 acres.

There are 50 homes build in the area right now, according to Fried who said at build out, he would expect no more than 300 to 400 homes.

Town Supervisor Anthony Cellini will now have 20 days to act on the petition as he will serve as the town's hearing officer.

Cellini said the town board raised a number of questions at a special session yesterday. ''Do they want to have their own fire department, do they want to have their own sewer plant? Do they want to have all of these services that we provide presently in their own village,'' he questioned.

"We have had good relations with the town," Fried said. He pointed to "the millions of dollars we put into the community with local contractors to build the houses, and taxes." Should the approvals be secured, the village would most likely contract with the town for certain services such as police and snow removal.

Hasidim seek village status

Kiamesha Lake – A Hasidic community plans to establish its own village in Sullivan County's biggest town, creating the first religious-based municipality in the region since the founding of Kiryas Joel nearly 30 years ago.
The Rockland County-based Viznitz sect filed papers with the Town of Thompson last week to incorporate as the Village of Ateres (meaning "Crown") off Route 42 between the Village of Monticello and South Fallsburg on Gibber Road. It would be the county's seventh village.
The group dropped off the petition and a $6,000 check at the Town Hall a few hours before the Sabbath on Friday, when Orthodox communities fast and devote themselves to prayer.
Thompson Supervisor Tony Cellini said he had no inkling that they planned to make the move.
"I would predict there will be some litigation in this matter," Cellini said yesterday.
"I am not too thrilled about it."
Community leaders say Sullivan has nothing to fear from their future village.
"We are good neighbors; we pay our taxes and we contribute to the economy," said Chayim Fried while sitting at his dining room table yesterday.
Fried said the community wants more control over its zoning and building codes in planning another 200 to 300 homes or condominiums.
"We need certain things in here that they wouldn't allow, like local stores," he said.
The Viznitz sect is not affiliated with Kiryas Joel. It is based in the Town of Ramapo in Rockland County, where in 1990 it created the incorporated Village of Kaser, which has a population of 3,316 in just two-tenths of a square mile.
Kiryas Joel is itself the product of a zoning dispute. The community, which began as a small enclave in the Town of Monroe in the early 1970s, broke free as a largely autonomous village in 1977 after repeated clashes with town officials.
The Hasidim tend to live in closely knit communities, with multifamily housing concentrated around synagogues, ritual baths and kosher-food stores.
Two village proposals emerged last year in southern Orange County amid fear that the Hasidic community of Kiryas Joel would seek to expand. Neighbors, who said they wanted to protect their area's zoning and character, petitioned to incorporate two new villages, one in Woodbury, the other in Blooming Grove.
Neither request has come to a vote. Opponents have filed lawsuits challenging both petitions on technical grounds.
The Thompson Town Board held a special meeting yesterday and had questions about the tax implications for the town and school district and is worried that shoddy buildings and apartment houses will proliferate.
The year-round Viznitz community in Sullivan has 37 box-framed homes. Most were built within the past three years and are 5,000-square-feet, multifamily dwellings. The total area of the village would be 377 acres. The taxable value of the properties is $8.9 million, which contributes roughly $269,000 annually in town, county and school taxes.
Cellini said he will schedule a hearing on Aug. 9. As the hearing officer, he has the power to veto the petition should he determine that it doesn't meet the technical requirements. The town is already looking closely at the petition.
The petition states that the community will have 596 residents, which is more than the 500 needed to incorporate as a village. However, more than 200 of names on the petition are listed as residents of 168 Yeshiva Road, a boys school at the former Gibber Hotel. The town's position is the 500 must be 18 or older and permanently reside in the village.
But the group's attorney, Terry Rice, who has handled several incorporation petitions in Rockland County, says that's not true.
"All they need is 500 regular inhabitants, men, women and children," he said.

The rules on forming a village

Under New York state law, an area with at least 500 "regular inhabitants" may incorporate as a village. The specified area cannot include part of any existing village or city. It also can't be larger than 5 square miles, unless its boundaries match those of a town or taxing district such as a fire district or school district. (Parts of more than one district can be cobbled together into a village larger than 5 square miles if those parts are all within a single town.)
"Regular inhabitants" means people of any age living in that area, except those who have homes elsewhere and are registered to vote at those other addresses.
A petition is filed with the town supervisor to start the process. The petition must be signed either by 20 percent of the area's qualified voters or by property owners whose combined land is worth at least half of the area's assessed value.
The supervisor must hold a hearing and then decide if the petition meets all technical requirements. If the petition is rejected, organizers can appeal to state Supreme Court. If it's approved, the town schedules a referendum for residents of the area that would form the village.
A simple majority of voters decides if a village is incorporated.
