Charges on the 26 arrested are:
1)
Burglary 3rd degree = D Felony
A person is guilty of burglary in the third degree when he knowingly
enters or remains unlawfully in a building with intent to commit a crime
therein.
2)
Criminal Mischief 2nd degree = D Felony
A person is guilty of criminal mischief in the second degree when with
intent to damage property of another person, and having no right to do
so nor any reasonable ground to believe that he has such right, he
damages property of another person in an amount exceeding one thousand
five hundred dollars.
3)
Criminal Trespassing 4th degree = Violation
A person is guilty of trespass when he knowingly enters or remains
unlawfully in or upon premises.
4)
Criminal trespassing 3rd degree = B misdemeanor
A person is guilty of criminal trespass in the third degree when he
knowingly enters or remains unlawfully in a building or upon real
property
(a) which is fenced or otherwise enclosed in a manner designed to
exclude intruders;
5)
Criminal mischief = A misdemeanor
A person is guilty of criminal mischief in the fourth degree when,
having no right to do so nor any reasonable ground to believe that he
has such right, he:
1. Intentionally damages property of another person; or
2. Intentionally particpates in the destruction of an abandoned
building as defined in section one thousand nine hundred seventy-one-a
of the real property actions and proceedings law; or
3. Recklessly damages property of another person in an amount
exceeding two hundred fifty dollars.
6)
Petit Larceny = A misdemeanor
A person is guilty of petit larceny when he steals property.
Sentences on the above charges are
For a class D felony, the term shall be fixed by the court, and
shall not exceed seven years;
Class A misdemeanor. A sentence to pay a fine for a class A
misdemeanor shall be a sentence to pay an amount, fixed by the court,
not exceeding one thousand dollars, provided, however, that a sentence
imposed for a violation of section 215.80 of this chapter may include a
fine in an amount equivalent to double the value of the property
unlawfully disposed of in the commission of the crime.
Class B misdemeanor. A sentence to pay a fine for a class B
misdemeanor shall be a sentence to pay an amount, fixed by the court,
not exceeding five hundred dollars.
Violation. A sentence to pay a fine for a violation shall be a
sentence to pay an amount, fixed by the court, not exceeding two hundred
fifty dollars.
