UNION-SLAP JUDGE UP FOR PROMOTION

December 26, 2005 -- The Brooklyn judge who levied a $1 million-a-day fine against the striking Transport Workers Union and threatened to toss its leaders in jail is set to move up in the world.
Judge Theodore Jones is being tagged by court officials as the likely appointee to a newly created post of administrative judge of the Brooklyn civil courts, sources said.
"He was given the transit case as a nice sort of segue into his new position," said one courthouse source. "It put him in the public eye and he did a great job."
Jones was "handpicked" to preside over state and city lawsuits field against the TWU, and he emerged as a key player in the three-day strike.
"It was appropriate that the incoming head [of the Brooklyn civil courts] handle that case," the source said.
When the judge heard news that negotiators from the Metropolitan Transportation Authority and TWU had agreed to a cease-fire that ended the illegal strike — without a new contract — he adjourned all legal matters to Jan. 20.
But sources say Jones is expected to be named to the position by next month, which could leave the transit cases in another judge's hands.
Office of Court Administration spokesman David Bookstaver said he would not comment on "courthouse scuttlebutt."
Jones, if appointed, would take over responsibility for civil courts from Administrative Judge Neil Firetog, who would remain head of the criminal courts.
The highly respected Jones, a St. John's Law School grad, first took the bench in 1990 and started his career dealing primarily with drug cases.
Jones was tossed a legal hot potato the next year, when prosecutors asked him to release the records of the grand jury that decided not to file charges in the case of 7-year-old Gavin Cato, whose death triggered the Crown Heights riots.
The judge, who was elected to a second 14-year term last year, said he wouldn't consider releasing the tran unless the 31 witnesses who testified agreed.
The transit strike was not his first brush with labor issues and the strife that can take place between unions and management.
Last year Jones handled a different kind of work dispute when he was asked by court clerks and court officers to block the phasing in of KRONOS, an electronic sign-in, sign-out attendance system.
The courthouse rank and file said this conflicted with language in their contracts. But Jones rejected their request for an injunction.
"He's one of the more experienced judges on the civil side," said one courthouse insider, who described Jones as an extremely well-liked and highly respected judge.

Hon. Theodore Jones Named Administrative Judge of Brooklyn Supreme Court, Civil Term
BROOKLYN, NY - Chief Administrative Judge Jonathan Lippman today announced the designation of Supreme Court Justice Theodore T. Jones as Administrative Judge of the State Supreme Court, Civil Term, Kings County. The appointment, effective immediately, was made with the approval of Chief Judge Judith S. Kaye and in consultation with Presiding Justice A. Gail Prudenti of the Appellate Division, Second Department.
In announcing the appointment, Judge Lippman stated, ''Justice Jones is a well-respected, long-standing member of the Brooklyn legal community, with an impeccable reputation both as an attorney and sitting jurist. His recent handling of the transit strike case clearly demonstrates his many admirable qualities of judiciousness, thoughtfulness, integrity and formidable intellect. After decades of public service both in the law and other fields, Ted Jones has proven himself to be an outstanding candidate for the position of Administrative Judge for the Civil Term. I heartily congratulate him on receiving the honor of this new position and eagerly look forward to working with him.''
The position of Administrative Judge for the Civil Term of Brooklyn Supreme Court is a new title, as the responsibilities of this position had previously been undertaken by Hon. Neil J. Firetog, who oversaw both the Criminal and Civil Terms. Judge Firetog will continue to serve as Administrative Judge over the Supreme Court's criminal parts.
''I am sincerely grateful to Neil Firetog for his diligence and dedication as Administrative Judge over the last two years,'' said Judge Lippman. ''Since the day the new courthouse opened on Jay Street, physically separating the criminal and civil court parts, the job of overseeing both civil and criminal terms has become increasingly difficult logistically, particularly since Brooklyn represents the largest Supreme Court administrative entity in the state. It makes good managerial sense now to have an administrative judge exclusively designated for each division, as is the case in many of the other New York City boroughs. I applaud Judge Firetog for his willingness to shoulder the heavy responsibility of supervising both divisions up to this time and am confident that the court community of Brooklyn will only benefit from this new administrative structure.''
Hon. Theodore Jones has been presiding as a Justice of the Supreme Court in Brooklyn since 1990. After graduating from St. John's University School of Law, he was employed by the Legal Aid Society, subsequently served as a law secretary to a New York State Court of Claims Judge and was in private practice before becoming a judge. He has a degree in education and political science from Hampton University in Hampton, Virginia, and was a teacher in the New York City public school system and a captain in the United States Army. He also has taught classes in legal studies at St. John's University School of Law and City College of New York. Justice Jones is on the Board of Directors for Judicial Friends, a former member of the Committee on Character and Fitness, Second Department, and a past recipient of the Brooklyn Bar Association's Judicial Excellence Award.
