The following are some excerpt from rosenwassers october 21 order:
The Court has visited
the Barasch decision in excruciating detail in an effort to find guidance to
assist in resolving the pending motions. Even the last sentence of the decision
which provides ''the Court leaves intact the status quo in terms of the
day-to-day operations of the Congregation and its institution'' is problematic.
By denying all requests for relief thereby terminating all prior temporary orders,
the ''status quo'' that Justice Barasch was referring to must be clarified since
he made no direct finding or issued any specific ruling or order with respect to the
''status quo.'' This Court concludes that the Barasch decision in denying the requested
relief has permitted the dispute regarding control of the Brooklyn Congregation to
continue since he declined to decide which members of the Congregation constituted
the duly elected board.
Notwithstanding anyone else's claim to the contrary, Justice Barasch's decision at the
very least leaves Berl Friedman the elected president.
To be sure, this court has no desire to re-litigate de novo those issues presented to
Justice Barasch and all of the foregoing merely represents this Court's analysis of
Justice Barasch's decision which this Court accepts and seeks to apply.
