Until he chooses to testify, he will remain behind bars up to a maximum of 18 months, according to federal prosecutors Zigelman has previously pleaded guilty and served a prison sentence for his role in a tax-evasion scheme by his Brooklyn-based orthodox sect, Spinka. After his release, he was subpoenaed to testify before a Los Angeles grand jury continuing its probe into the scheme.
Citing an ancient Jewish principle, Zigelman refused to testify, telling a federal judge forcefully during a contempt hearing through a Yiddish interpreter: “Because the transgression of mesira is so dire, my mind won’t change until I die.” The rabbi had asked that he be allowed to enter custody after observing Passover, in April. Prosecutors objected, saying March will mark one year since Zigelman was first called to testify and additional delays will require extensions to the grand jury’s term of service. Morrow ordered him to surrender to the prison March 21.

In December, in an order that was sealed because grand jury matters are confidential, U.S. District Court Judge Margaret M. Morrow held the rabbi in civil contempt. Zigelman's attorneys, who have maintained that no amount of earthly sanctions will compel the rabbi to change his steadfast beliefs and that his 1st Amendment right to religious freedom was being violated, appealed unsuccessfully to the 9th Circuit Court of Appeals. The rabbi had asked that he be allowed to enter custody after observing Passover, in April. Prosecutors objected, saying March will mark one year since Zigelman was first called to testify and additional delays will require extensions to the grand jury's term of service. Morrow ordered him to surrender to the prison March 21. "The government doesn't want to be in a position of remanding somebody into custody, what the government is trying to seek is to have truthful testimony in court proceedings," Asst. U.S. Atty. Daniel O'Brien said Friday. "All people who are percipient witnesses to facts that are relevant to criminal matters have a duty to testify when called to do so before a grand jury." An attorney for the rabbi could not be reached for comment.

האדמו"ר מספינקא-בורו פארק ריצה, בעקבות חשיפת הפרשה, תקופת מאסר בבית הכלא אולדסוויל בניו-ג'רזי.
זיגלמן, גבאו של האדמו"ר, כבר ריצה תקופת מאסר בעבר, אך לפני שנה התעוררה מעורבותו בפרשה פעם נוספת, לאחר שהאף.בי.אי דרש ממנו להעיד נגד חסידים החשודים כמעורבים בפרשה.
בית המשפט האשים את זיגלמן בביזוי רשויות החוק וגזר עליו 18 חודשי מאסר.
זיגלמן הסביר לשופט הפדראלי, באמצעות מתורגמן לשפת היידיש, את חומרת עבירת ה'מסירה': "דעתי לא תשתנה עד יום מותי".
עורכי דינו ביקשו מבית המשפט לדחות את כניסתו לכלא עד לאחר הפסח, כדי שיוכל לחגוג את החג במחיצת בני משפחתו. התביעה התנגדה לבקשה, ובית המשפט הורה לו להתייצב כבר ביום רביעי במתקן הכליאה הפדראלי בברוקלין. |

The Los Angeles Times reports (http://lat.ms/VyWsiM ) Judge Margaret Morrow ordered Rabbi Moshe Zigelman freed Monday, after he spent seven months in a Brooklyn jail. Morrow ordered Zigelman freed when a federal prosecutor agreed in court papers that “additional incarceration would be futile” in compelling the rabbi to testify. Zigelman was found in civil contempt in Dec. 2011 after Morrow rejected his attorney’s argument that forcing him to testify would violate his First Amendment religious freedom. The Jewish doctrine of mesira bars Jews from informing on other Jews to secular authorities. Zigelman had been called before a grand jury regarding an investigation into the Spinka sect, which was accused of tax fraud. He had pleaded guilty in 2008 to criminal conspiracy and received a two-year prison sentence.

| | סערה בחסידות ספינקא: עסקני החסידות מאשימים את שלטונות החוק האמריקאים באטימות משפטית, זאת בעקבות את הסאגה המתנהלת בימים אלו נגד משב"ק האדמו"ר מספינקא – בורו פארק, הרב משה לייזער זיגלמן, שישב במשך שמונה חודשים בכלא בלוס אנג'לס - בשל סירובו להלשין על אחרים.
כעת מתברר, כי הרב זיגלמן עשוי להיכנס שוב לכלא למספר חודשים, בשל סירובו להלשין בפרשייה נוספת, מספיחיה של פרשיית הלבנת הכספים.
כזכור, רק לפני חודש וחצי חגגו בחסידות את שחרורו של הרב זיגלמן מבית הסוהר הפדראלי, עוד בטרם הגיש עורך דינו ערעור.
עכשיו מתברר, כי שופט נוסף שדן בספיחי הפרשיה, זימן את זיגלמן להעיד במשפט, אלא שזיגלמן היה אז עצור בבית הסוהר ולא הופיע. השבוע עלתה הפרשה שוב בבית המשפט, וזיגלמן שנמצא בתקופת 'שחרור מוקדם על תנאי' - לא הופיע בבית המשפט להעיד.
בנו של זיגלמן מסביר: "שחרור על תנאי הוא שחרור מוגבל מאוד, שבו נלקח מהאסיר דרכונו, ועליו לבקש רשות בכל יציאה שלו מחוץ לעיר בה הוא מתגורר. אבא קיבל 'שחרור על תנאי' לשלוש שנים, שזה המון זמן. השלטונות פשוט רוצים לנסות לשבור אותו כדי שילשין על חסידים, הם מאמינים שבתור משב"ק הוא יודע הכול על כל אחד ואחד בחסידות".
הבן ממשיך: "כשנמצאים במעמד של 'משוחרר על תנאי' זהו מצב מאוד רגיש, כי כל עבירה קטנה שאדם עושה - ואפילו בטעות - יכולה לבטל את השחרור והאסיר ישוב לכלא. בשבוע שעבר דן בית משפט בלוס אנג'לס בפרשה נספחת לפרשה המרכזית, אבא נקרא להעיד, אך לא הגיע - כי נאסר עליו לעזוב את ניו יורק. השופט התרגז ובשבועות הבאים יחליט אם לבטל לאבא את מעמדו ולהחזירו לכלא, או לקבל את הטיעון של עורך דינו שטען לחפותו", הוא מסיים, ומבקש מהציבור להתפלל עבור משה אליעזר בן אסתר. |
