Alito to Senate: Judges Can't Have Agenda

WASHINGTON

Supreme Court nominee Samuel Alito said Monday that judges should operate free of any agenda or preferred outcomes as the Senate opened hearings on President Bush's choice for the high court.
"A judge can't have any agenda. A judge can't have a preferred outcome in any case," Alito told the Senate Judiciary Committee in a brief statement in which he made the distinction between judges and attorneys working for clients.

WASHINGTON (AP) - Democrats on the Senate Judiciary Committee said Wednesday they were troubled by what they see as inconsistencies in Supreme Court nominee Samuel Alito's answers on issues ranging from voting rights to ethics to his membership in a conservative organization.
On the third day of confirmation hearings, Sen. Patrick Leahy of Vermont said Democrats would press President Bush's choice to replace retiring Justice Sandra Day O'Connor on several statements he made in his earlier testimony.
"A number of us have been troubled by what see as inconsistencies in some of the answers," Leahy told Alito.
Republicans hold the majority in the Senate - 55-44 with one independent - and Alito, a federal appeals judge, is expected to win confirmation to the high court unless some GOP lawmakers oppose his nomination

ALITO WIFE LEAVES HEARING IN TEARS AFTER DEM ATTACK

Judge Samuel A. Alito's wife Martha left the confirmation hearing room in tears this evening, the DRUDGE REPORT has learned.

Sen. Lindsey Graham (R-SC) apologized to the Judge's family for the behavior of his fellow committee members during the course of the last three days.

Sen. Graham said: ''Judge Alito, I am sorry that you've had to go through this. I am sorry that your family has had to sit here and listen to this.''

Democrats on the Judiciary Committee have attacked Judge Samuel A. Alito over his membership in Concerned Alumni of Princeton and his involvement in the Vanguard case.

One senior Republican in the hearing room said of the situation: ''After three full days of attacks against her husband's character, Mrs. Alito had enough. Democrat behavior during this hearing has not only been wrong, it's been embarrassing. Ted Kennedy is nothing but a bully.''

Washington -- For a moment Wednesday, Sen. Edward Kennedy seemed poised to take down Judge Samuel Alito's Supreme Court nomination. But he fired a blank.
Within the span of a lunch break, Kennedy's demands to subpoena documents that could verify whether Alito was lying to the Judiciary Committee about his involvement with Concerned Alumni of Princeton (CAP) had melted into jokes about Kennedy's absence from the Senate gym.
But not before the White House, the Republican National Committee, Senate Majority Leader Bill Frist and Alito's army of supporters opened a full-court defense to smother the controversy before it could gain momentum.
The documents in question were quickly released by San Francisco resident William A. Rusher, 82, a founder of the conservative Princeton group and former publisher of National Review.
Rusher could not be reached for comment Wednesday, but he told National Review he hadn't looked at the files in 30 years. "I hope there is nothing discreditable in them," he said. "Of course, Sen. Kennedy can always hope."

WASHINGTON (CNN) -- Sen. John Kerry will attempt a filibuster to block the nomination of Judge Samuel Alito to the Supreme Court, CNN has learned. Kerry, in Davos, Switzerland, to attend the World Economic Forum, was marshaling support in phone calls during the day, he told CNN. Kerry said he told a group of Democratic senators Wednesday, and urged that they join him. Kerry said he has the support of fellow Massachusetts Sen. Edward Kennedy. Some senior Democrats told CNN they are worried that the move could backfire. Republicans would need 60 votes to overturn a filibuster -- a procedural move that extends Senate debate indefinitely, effectively blocking a vote. Senior White House officials said the move would make the Democrats look bad, and that Republicans believe they have enough votes to overcome any filibuster attempt. Nearly all 55 Republican senators have said they will vote for Alito. Only three Democrats -- Sen. Ben Nelson of Nebraska, Sen. Robert Byrd of West Virginia and Sen. Tim Johnson of South Dakota -- have said they will vote for the nominee. Earlier Thursday, Democratic Sen. Mary Landrieu of Louisiana said she would oppose a filibuster. "Because we have such a full plate of pressing issues before Congress, a filibuster at this time would be, in my view, very counterproductive," said Landrieu, who is pushing the Senate to focus on the rebuilding of the Gulf Coast in the wake of Hurricanes Katrina and Rita.

Hillary Clinton yesterday backed a rebel band of Senate Dems seeking to filibuster a vote on the Supreme Court nomination of Judge Samuel Alito. Democratic leaders had warned that filibuster efforts were going nowhere and would let President Bush score easy political points, but Clinton said, "I oppose his nomination and support efforts to block his confirmation." "I do not think Judge Alito would advance the principles Americans hold most dear," she said, adding she would vote against a move to cut off a filibuster should one occur. Any senator can filibuster - or command the floor to block a vote. It takes 60 votes to invoke cloture to end a filibuster. Senate Minority Leader Harry Reid (D-Nev.) made it clear earlier in the day that the party didn't have the votes to defeat a cloture vote, so a filibuster was doomed to failure. Nevertheless, Sens. John Kerry (D-Mass.) and Ted Kennedy (D-Mass.) have pushed for a filibuster, a move that delights Republicans. "If the Democratic left does a filibuster led by Kerry, that's found money for us," a top GOP official said. The filibuster tactic could have repercussions for Clinton. Her move is bound to be seen as an appeal to the liberal base that dominates the Democratic presidential primaries, following several Senate votes that could be seen as attempts to move to the center. In an interview on the "CBS Evening News," Bush said of Clinton's 2008 chances, "She's formidable." A spokesman for Sen. Chuck Schumer (D-N.Y.) said he had made no decision on a filibuster and declined comment on Clinton's move.
