The 18-year-old New Square man charged with trying to murder a village dissident through an arson attempt was released this afternoon after being arrested on a charge of violating a court order to stay away from the family.
Ramapo police arrested Shaul Spitzer this morning after he left the Rockland County Courthouse in New City following an appearance on felony charges of attempted murder, arson and assault.
Police accused Spitzer of walking outside Aron Rottenberg's Truman Avenue house on Oct. 4 at 3:15 p.m. in violation of a court order to stay away from family members, their home and business, Ramapo police Detective Sgt. John Lynch said today.
Spitzer, who lived in Grand Rabbi David Twersky's house and worked as his butler, appeared before Ramapo Justice Rhoda Schoenberger this afternoon on a misdemeanor count of second-degree criminal contempt.
The Rockland District Attorney's Office recommended no additional bail, believing the $300,000 on the felony charges was sufficient, Lynch told Schoenberger.
Schoenberger noted she got the case because the New Square judge was unavailable. She released Spitzer, who is scheduled to appear in New Square Justice Court on Nov. 21 at 6 p.m.
Defense attorney Kenneth Gribetz, said after court that Spitzer would plead not guilty to the misdemeanor charge at that time.
A community member took a photograph of Spitzer and some friends in front of the Rottenberg house. The individual sent the photo to the Rottenbergs, who sent the photo to the police. The police investigated and after finding the community member and doing interviews, they made the arrest.
Gribetz said Spitzer made an "innocent mistake" and has been told in no uncertain terms he's not to go near the Rottenberg house. Gribetz said the synagogue and the grand rabbi's house are near the Rottenberg home.
Rottenberg's son-in-law, Moshe Eilbaum, said the family was pleased the police took action.
Spitzer has pleaded not guilty to charges of arson and attempted murder that accuse him of trying to set Rottenberg's house in New Square on fire at 4:15 a.m. May 22. That case was adjourned today until Jan. 11 for possible trial.
During a confrontation outside the house that May morning, police contend, an incendiary device of Spitzer's exploded, burning Rottenberg over 50 percent of his body.
Rottenberg was hospitalized for months with third-degree burns, undergoing skin grafts and other medical procedures. Spitzer suffered severe burns to his hands and arms.
Rottenberg and others had been the target of street protests and vandalism last year for not praying in Twersky's synagogue. Rottenberg led a contingent that prayed at the Friedwald Center on New Hempstead Road, less than a mile from New Square.
At the time of the arson attack, Spitzer lived in the grand rabbi's house and did butler-type work for the Hasidic Jewish leader. The rabbi later condemned the violence.
There also are accusations being investigated that young men like Spitzer enforce the edicts of the grand rabbi and his inner circle, including social rules, like dress codes, and worship practices. The Ramapo police have been investigating the vandalism against Rottenberg and any conspiracy to deny him and others their rights to practice their religion. The FBI has been monitoring the case.

רוטנברג נפצע וסבל מכוויות קשות. שפיצר נעצר אז וישב בכלא, אך בשלב מסוים הצליחו עסקני סקווירא לשחרר את שפיצר בערבות עם תנאים מגבילים.
התנאי העיקרי היה האיסור להתקרב לביתו של רוטנברג.
הבוקר (ד) נעצר שפיצר ע"י המשטרה בעוון הפרת "תנאי השחרור בערבות".
המשטרה האשימה את שפיצר שהוא עומד מול ביתם של רוטנברג בשדרת טרומן בסקווירא ומטריד את מנוחתם.
בית המשפט האשים את שפיצר בהפרת תנאי שחרור, זילות בית המשפט והתפרעות.
את תגובתו של עורך דינו של שפיצר, קנט גריבוז, לא ניתן היה להשיג.

Rottenberg and other male residents had drawn the ire of religious leaders and Twersky for publicly refusing to follow the rabbi's edict that his followers pray during the weekly sabbath in the village's only synagogue. Rottenberg instead led a contingent that prayed with residents at the Friedwald Center on New Hempstead Road, less than a mile from New Square. As part of Spitzer's $300,000 bail, the judge signed an order mandating Spitzer stay away from the Rottenberg family, their home and business. The police investigated and after doing interviews, they made the arrest on Wednesday. The Rottenberg family had told the authorities about the photo, said Moshe Eilbaum, who is Rottenberg's son-in-law. "We are pleased that law enforcement is enforcing the order of protection, though we wish enforcement would have been more rapid," Eilbaum said. Rottenberg continues to recover from third-degree burns and several skin graft operations, Eilbaum said. Rottenberg, a plumber, is getting feeling back into his hand and is pursing his civil lawsuit against Twersky, Spitzer and others. Gribetz said on Wednesday that Spitzer has been told not to go near the Rottenberg house. He said the community's one synagogue and the grand rabbi's house are near Rottenberg's home. "This was an innocent mistake," Gribetz said. "My client wasn't aware he was in violation. "He didn't harass anyone or go on the property," Gribetz said. "He shouldn't have been there. It will never happen again." Spitzer's next scheduled court appearance on the attempted murder charge is Jan. 11 before state Supreme Court Justice William Kelly in New City. Gribetz has said he expects the case to go to trial. He has argued that Spitzer is contrite and didn't intend to kill or hurt anyone or even try to burn down the Rottenberg house with a gasoline-soaked device. Exclusive: Is There A Backroom Deal In The New Square Arson/Attempted Murder Case?Rottenberg before full cleanup and bandaging  Shaul Spitzer  Did Skvere hasidic leaders offer Aron Rottenberg, the New Square dissident grievously burned in an arson attack allegedly carried out by the Skvere Rebbe's butler, close to $2 million dollars to drop the criminal charges against that butler?The fix, it seems, is almost in. Shaul Spitzer, the 18-year-old haus bucher (butler/gopher) of the Skvere Rebbe, Dovid Twersky, allegedly tried to murder New Square dissident Aron Rottenberg and his family just after 4:00 am on Lag Ba'omer last May by burning them alive. Spitzer was charged with attempted murder and arson. Nine days ago, I reported that Spitzer had turned down a plea deal offered by prosecutors. The deal would have seen Spitzer sentenced to 13 years in prison. He could be sentenced to 25 years if the case goes to trial and he is found guilty. I also reported that because of the overwhelming evidence aginst Spitzer, there were fears that Spitzer's refusal to accept the plea bargain meant that Skvere leadership had made arrangements for Spitzer to flee the country. Now a reliable source close to Skvere leaders tells me that Aron Rottenberg has been offered $1.6M dollars by Skvere leaders to drop criminal charges against Spitzer. This source says that Rottenberg is negotiating with these leaders and is expected agree to a deal soon. A different source familiar with the status of the criminal case against Spitzer believes the deal might work like this: 1. Rottenberg would be paid a large amount of money under the table in cash. 2. He would also be paid an amount of money above the table as a settlement for his civil suit against Spitzer. 3. Other forms of compensation, perhaps involving Rottenberg-owned property in New Square, may also be in the works. 4. In return for these payments, Rottenberg would refuse to cooperate with the criminal prosecution of Spitzer, would drop the civil suit against him, and would agree to not pursue any lawsuits or other actions against Skvere, its institutions or the Skvere Rebbe. Rottenberg suffered third degree burns over more than 50% of his body in the Lag Ba'omer attack. Rottenberg could not be reached for comment.
